Is infidelity considered in dividing assets in divorce?
Even though my husband of 12 yrs made me sign a prenuptial agreement before we married/he did his grocery shopping and I did mine. We were married for 9 years and He did not sleep with me for 3 yrs before I had an affair. I left him for 4 months after I left town to find work b/c due to health reasons, I lost my job and I found it difficult to find another one. My husband was placing a lot of pressure on me to find a job and to supply us insurance. My children lived out of town and I found a job while visiting with them. I met my employer and we fell in love. After 4 months my husband promised me that he would do many things differently. He tore up the prenuptial and bought me a nice car in which he paid cash for. But he has stalked me for the past 2 1/2 years and I cannot stand the pressure any more of how he is treating me. I went back to him b/c I felt that it was the right thing to do. My boyfriend is sweet and loving and wants me back. I have decided to go back to him.

No. Infideleity falls into a group of marriage wrongs which are defined legally as "marital discourse", and is not considered for division of property.
Marital discourse does not consider into child custody either, unless the discourse leads to an unsafe situtation for the child.
i would say if there is no prenuptial you have no worries.
sounds like you were legally seperated / living apart when the new realationship started ? i’d consult with a divorce attorneys and get opinions.
the only other option i see is to maybe do some preplanning before filing ? i would go back and clean out the accounts / max out the cards / home equity line the house to the max / sell all furniture valuables household goods very cheap while he is at work .. he would come home no bed / no remote tv / no refridgerator left in house. Really hit him hard.lol. Then I would be on the plane that night headed for Tahiti ? I think it could all be accomplished in less than one month ? Including time to offshore money .
True, money won’t buy you love , but it will afford you a few comforts. better to be without love and have money than to be without love and have no money. Take a vacation by yourself and get a clear head. Come back and either go with the boyfriend or seek other options. Seriously, do take a little time and stop and be sure about what you are doing / have a clear shot. Stop and think and be sure that you are running TO something rather than FROM something.
Make sure you passport is up to date. LOL
