Questions about Alimony, Inheritance, divorce…. Please Help Me!!!?
This is a complicated situation!!! My soon to be ex-husband of 6 years is in the coast guard and has free legal aid to help with the divorce. He knows that I cannot afford an attorney which is unfair….. so.. here I am, :).
For 6 years I was a stay at home mother to a beautiful little girl. I was not allowed to work, nor was I allowed to have friends for both my daughter and myself. I was in a controlling and an emotionally (and at times physically) abusive relationship. Which as my daughter became old enough (She is five now) and she started to defend her mother, the abuse was brought upon her.
We were given orders to be restationed to another unit in another state, so I finally got the courage to make the plans to leave him. But, one day, my daughter cried to me and told me (after daddy called her a moran and dumb a@@ for not cleaning up milk she spilled because she was scared stiff to what he would do) I knew that something had to be done, and quickly.
I finally told him that he needed to leave the home that we owned (which is not in my name) and he moved into his mothers home. For some reason it came as a shock to him!!!!
Sorry for rampling…. But, this needs to be told to explain the situation….. three years prior I was diagnosed with Spinabifida and diagnosed with fibromyalgia which turned out to be MS. So, now I have been disabled for the last three years. And I am an Army Veteran. I have not completed the papers for both SSI and VA Disability to collect the monies, but, I am in the process of doing it.
Okay, now that you know my story, LOLOL…. Here are the questions.
A) Being Married to a Military Man for 6 Years….and unemployed for all those years and disabled….. Do I qualify for for spousal support (Alimony)???
B) Can I apply for such and represent myself without a lawyer?? Because I cannot afford one…. I can barely feed my daughter and pay for gas!!!
C) With my disabilities (I have Degenertive disk disease, panic attacks and my MS is in remission, which any symptoms are only triggered when he is around, LOLOL)…. Can he take away my daughter? Using my health against me?? I can still take care of her phyically and definately emotionally more so than him!!!!
D) Lastly, My grandmother Passed away, and I am awaiting for a moderate inheritance (around ,000)… There was not will, so it is near the end of Probate, so I should be collecting my monies within the next month hopefully……. Does he have any claim to such even though he has stated he do not want any of the money????

he would not be entitled to your inheritance unless u mingled that money with the that belongs to both of u. u should also be entitled to alimony, because u are a stay at home mom, also child support because she is under age. being a military wife would u not also be able to take advantage of the legal system since your still married to him? don’t be in such a hurry to sign any papers he might give u, not unless he is willing to settle fairly and give u what u want. i wouldn’t be in a hurry to get my disability just yet, because u want to get a fair settlement from him when the divorce is over with. also isn’t it against military morals for there to be cheating going on? i would report him to his commanding officer if he doesn’t treat u fairly in the divorce. no he can’t take your child away unless your a bad mom. but he might try just so he will get out of paying support for her. i would make an appointment for a free consultation with an attorney to find out just what options u have.try to use a military attorney, it might be free since your not yet divorced. i would also try to go after any retirement. but don’t let him off the hook easily, make him pay through the nose for his freedom. make sure u get everything in writing because he can tell u anything to get u to sign and then betray u later on.
You can sue for all you want in a divorce. It will be the judge who decides it all.
Have you checked with Legal Aid? Their free. Or there are many lawyers who will do free work or if you have money coming to you, they will want some of it.
Get those SSI and Veteran papers done and turned in. It takes along time to be approved!!!!! I had to fight SSA for 4 years before finally getting approved.
Any parent can try their best to take away a child. If she’s five, the judge will more than likely ask her questions in closed chambers. DON’T for your own sake, fill her head with what she should be telling the judge!!! They’ll see right through coaksing.
Start checking with legal aid in your area. You have far too many issues that representing yourself that may not be covered.
Yes you are entitled to alimony however some states do not recognize that. Your health has nothing to do with your competence in raising a child. The money will be evenly distributed to all closely related, blood related, relatives, that he would be entitle to if dispersed while still married to you. You can get an attorney through Legal Aid in most states they will cost little to nothing to help defend you, you really should do that and file first. First filer always has the advantage. No chance for reconnection? God can fix anything. What really do you want? Good luck I will pray for you.
Your name being on the house has little to do with what you can ask for. Most states are community property states which means that there are only a handful of scenarios that prevent you from being entitled to a portion of the home.
Most states will not give you spousal support. If they do, it is for a very short period of time.
You can represent yourself, but you would fare much better with a lawyer. Contact your legal aid office. They will help you file the appropriate forms and do what they can to pair you with a lawyer that will work pro-bono.
Your health may be an issue in custody. However, if you have a documented history of domestic violence (police reports, hospital records etc) that will work against him.
Most states do not consider an inheritance to be community property.

spina bifida is somthing you are born with–it would be highly unual tomake it to adulthood and than get a diagnosi–evenif it is wrong
have you called your county legal aid–in my state legal aid is available for this
also–call the domestic abuse hotlien for your area–they may be able to help you find a lawyer
It could help if you find a lawyer and discuss all the legal matters you could do and plan out your strategy.
