Cheating in the Army if you’re spouse won’t sign divorce?
Okay, so what happens if oh say, some woman has been trying to get a divorce from her husband for quite some time?However he won’t sign the papers, but they haven’t even lived together for over a year and she isn’t deployed. Then this woman starts a relationship with another person, would the attempt at divorce negate the UCMJ action or would it have to be finalized before that was possible?

First talk to a jag about the ucmj. Then talk to a real attorney about the divorce. Be careful with the new relationship. If necessary talk to the commanding officer, they should be able to point you in the right direction. You might be able to get the court to make him sign the papers.
IMO its really up to your command. If they want to go by the letter of the law then yes, you can get into trouble. But I am sure they would be understanding. When I got my divorce I was dating and my whole command new I wasn’t divorced yet but new that I was working on it and they didn’t try to bust me. So as someone stated above me, talk to legal, thats your best bet.
